1. Introduction

These Terms of Service ("Terms") govern your use of the ftureX platform and website located at fturex.com ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

ftureX is operated from Sweden. If you do not agree with these Terms, please do not use the Service.

2. Service Description

ftureX is a feature flag and toggle management platform that allows developers to control feature releases across environments for .NET, React, and Vue applications. The Service includes a web-based dashboard, client SDKs, and related documentation.

3. Account Registration

To use certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials confidential.
• Notify us immediately at hello@fturex.com if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account.

4. Pricing & Payment

ftureX offers a free tier. If we introduce paid plans in the future, we will clearly communicate all pricing including applicable taxes (Swedish VAT at 25%) before you are charged. No payment will be taken without your explicit agreement.

5. Right of Withdrawal (Consumers)

If you are a consumer residing in the EU/EEA, you have the right to withdraw from a paid subscription within 14 days of purchase, in accordance with the Swedish Distance Contracts Act (distansavtalslagen, SFS 2005:59). To exercise this right, contact us at hello@fturex.com.

If you have actively used the Service during the withdrawal period and gave prior consent to begin the service immediately, you may be charged a proportional amount for the service already provided.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service, except where permitted by applicable law.
• Use the Service to store or transmit malicious code.
• Resell or redistribute the Service without written permission.

7. Intellectual Property

All content, trademarks, logos, and software associated with ftureX are owned by us or our licensors and are protected by Swedish and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without written permission.

You retain all rights to the data you upload to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will do our best to notify you in advance of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by Swedish law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim arising from the Service is limited to the amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for fraud, wilful misconduct, or anything that cannot be excluded under Swedish consumer protection law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, after giving you reasonable notice where possible.

Upon termination, your right to use the Service ends. We will retain your data for the period described in our Privacy Policy, after which it will be deleted.

11. Complaints & Dispute Resolution

If you are unhappy with the Service, please contact us at hello@fturex.com and we will do our best to resolve the issue.

If we cannot resolve the matter, consumers in Sweden may file a complaint with the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at www.arn.se. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or emailing you at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved by the Swedish courts, without prejudice to any mandatory consumer protection rules that may apply in your country of residence.
